Josh Cohen

Josh’s practice focuses on all areas of estate, trust, and incapacity law. Josh primarily assists high net worth individuals, including business owners, with their personal estate plans, and the preparation of single and multiple wills, powers of attorney, and inter vivos and testamentary trusts.

Josh works together with corporate, tax, and insurance professionals to achieve client objectives and provide optimal solutions, ensuring that all issues are considered, including both domestic and foreign tax minimization, as well as ‘double taxation’ in certain jurisdictions.

Josh also assists clients with estate administration matters, including complex high value estates, and advises both estate trustees and beneficiaries on their rights, duties, and obligations.

Prior to joining O’Sullivan Estate Lawyers LLP, Josh worked in the private client group at a full-service downtown Toronto law firm, primarily on complex litigation matters involving the validity and interpretation of wills, removal of trustees and attorneys for property, passing of accounts, resulting and constructive trusts, and dependents’ relief. Josh also assisted clients with estate planning and administration matters.

While primarily focusing on estate planning and administration matters, with the goal of minimizing disputes and litigation risks, where appropriate, Josh also maintains his estate litigation practice.

Josh uses his wealth of broad-based knowledge and experience in estate and trust matters, whether estate planning, estate and trust administration or estate litigation, to provide clients with an exceptional level of service. Josh understands the sensitive nature of estate matters, and his tactful and personable approach has earned him praise from both clients and peers.

Josh has been recognized by Best Lawyers Canada™ since 2023 and has earned his Trust and Estate Practitioner (TEP) designation—an internationally recognized hallmark of professional expertise in the areas of Estate and Trust Law by the Society of Trust and Estate Practitioners (STEP). Josh’s specialized skill set enables him to provide clients with comprehensive and practical advice, delivered efficiently and cost-effectively.

Josh is an active member of the Advocates’ Society and the Ontario Bar Association’s Trust and Estate Section. He is a frequent speaker on various estate and trust topics for many professional organizations.
